The legal adviser for the Tulsa Police Department is Phil Cozzoni.  He advises the Chief of Police and his management staff on legal issues in the areas of:
Civil Rights

  • Use of Force; deadly, excessive
  • Arrest and Detention
  • 5th Amendment, illegal interrogation
  • 6th Amendment, denial of counsel
  • Assists Litigation Division in defense of the Chief of Police, Tulsa Police Officers and the Department

  • Federal, State and Municipal laws
  • 4th, 5th, 6th, 14th Amendment Issues
  • Search and seizure issues; Miranda, warrants etc
  • Confessions; admissibility,Right to an Attorney
  • Due Process
  • Expungement of Arrest Records
  • Liaison between TPD and Tulsa County District Attorney’s office on many issues

Labor and Employment

  • Internal Affair’s Investigations
  • Assists with Civil Service and Arbitration Matters
  • Due process in employment hearings
  • Member of Deadly Force Review Board
  • reviews conduct of officers when called upon to use deadly force
  • Advises on changes to existing policy and procedure or on the creation of new policy and procedure

Reviews Subpoenas/ and Subpoenas Duces Tecum for compliance or for objection

  • Juvenile, excessive burden on the City, confidential
  • Untimely notice, improper service etc

Law Enforcement education

  • Instructs the new Apprentice Police Officers in laws of arrest, pursuit, exclusionary rules, search and seizure, courtroom conduct etc
  • Publishes the Legal Bulletin
  • Advises officers of new legislation
  • Contains new case law on all levels of criminal justice from Supreme Court to Tulsa County
  • New Sgt./Cpl. School, Legal In-service training for the entire police department
